1. Acceptance of Terms

By accessing or using ViewPump ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time, and continued use constitutes acceptance of changes.

2. Description of Service

ViewPump is a SaaS platform that helps content creators discover trending content from TikTok, YouTube, and Instagram, process videos into reusable clips using AI, and publish content to connected social media accounts. The Service includes trend scanning, video downloading, AI-powered scene detection and clip tagging, remix tools, and social publishing.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information and be at least 13 years old to use the Service.

4. Subscription and Billing

ViewPump offers free and paid subscription tiers. Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

• You may cancel your subscription at any time from the Settings page
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• We reserve the right to change pricing with 30 days notice

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload, publish, or distribute content that infringes on intellectual property rights
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to harass, abuse, or harm others
• Resell or redistribute the Service without authorization
• Use automated tools to scrape or extract data from the Service beyond normal use
• Circumvent usage limits or subscription tier restrictions

6. Content and Intellectual Property

Your Content

You retain ownership of content you create or upload. By using the Service to process videos and generate clips, you grant us a limited license to store and process that content solely to provide the Service to you.

Third-Party Content

ViewPump discovers and processes publicly available content from social media platforms. You are solely responsible for ensuring your use of discovered content complies with applicable laws, platform terms of service, and the intellectual property rights of content creators. ViewPump does not claim ownership of third-party content.

Our Service

ViewPump, its features, design, and technology are protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Service.

7. Social Media Publishing

When you connect your YouTube, TikTok, or Instagram accounts and use the publishing feature, you acknowledge that:

• You authorize ViewPump to publish content on your behalf to connected accounts
• You are responsible for the content you publish through the Service
• Published content must comply with each platform's terms of service and community guidelines
• You can disconnect social accounts at any time, immediately revoking publishing access
• ViewPump is not responsible for actions taken by social platforms (content removal, account restrictions)

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from Service downtime.

9. Limitation of Liability

To the maximum extent permitted by law, ViewPump shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that trend predictions will be accurate, that content will go viral, or that the Service will meet your specific requirements.

11. Termination

We may suspend or terminate your account if you violate these Terms or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time from the Settings page, which will permanently remove all your data within 30 days.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
